There was no application for extension of time nor any leave granted to file the appeal out of time. The facts were uncontested and the appellants did not provide any justification or evidence of compliance with the statutory requirements. As a result, the court held that the appeal was incompetent for being filed out of time without leave and accordingly struck it out. The court further ordered the appellants to pay costs to the respondent.
