Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial magistrate erred in declining to read and adopt the Provincial Appeals Committee award as a judgment of the court.
  2. 2 Whether the trial magistrate exercised her discretion judiciously in striking out Award No. 59 of 2011 and refusing review and consolidation with Award No. 47 of 2011.
  3. 3 Whether the existence of a prior adopted award precluded the adoption of a subsequent contradictory award in respect of the same subject matter and parties.
