Ratio Decidendi

The court found that the consent entered into on 10/1/1985 in Eldoret HCCC No. 315 of 1978, which allocated the suit land among 68 members of the second defendant, remains valid and binding. Although a subsequent consent endorsed by the Deputy Registrar sought to set aside the 1985 consent, this later consent was itself set aside by Justice Nambuye in a ruling delivered on 30/9/1996. The effect of this ruling was to revert the parties to the position as at 10/1/1985, with the original consent remaining in force unless and until properly varied by a new consent. The plaintiffs' argument that the second defendant is only entitled to one-sixth of the land was rejected, as the 1985 consent...
