Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicant should be granted leave to appeal out of time from the judgment in Winam SRMC CC. No. 88/2009.
  2. 2 Whether the absence of a certificate of delay is fatal to the application for leave to appeal out of time.
  3. 3 Whether the grant of leave to appeal should be conditional upon the deposit of taxed costs by the applicant.

Ratio Decidendi

The court found that the applicant has a fundamental right to appeal and that the absence of a certificate of delay should not bar the exercise of this right, especially in light of constitutional provisions requiring courts to administer justice without undue regard to procedural technicalities. The court further held that making the grant of leave conditional upon the deposit of costs would unjustly restrict the right of appeal. The respondent retains remedies to recover costs through execution or by seeking security for costs in the appeal. Accordingly, leave to appeal out of time was granted without the condition of prior deposit of costs.
