Ratio Decidendi

The court found that the applicant/objector, Vincent Ojiango Magero, had established prima facie ownership of Motor Vehicle Registration No. KAE 208R by producing the registration certificate in his name. The applicant was not a party to the proceedings that resulted in the decree, and the respondent/decree-holder did not challenge the applicant's ownership or file any response to the objection. By operation of Section 8 of the Traffic Act, the applicant is presumed to be the owner unless the contrary is proved, which was not done. Therefore, the attachment of the vehicle was unjustified and must be lifted, and the vehicle released to the applicant.
