Ratio Decidendi

The court found that only the 1st Respondent and 1st Interested Party sought costs and had actively participated in the proceedings, including filing applications and making court appearances. The applicant withdrew the suit after it was overtaken by events, but the 1st Respondent and 1st Interested Party had already incurred costs in defending themselves. Applying Section 27 of the Civil Procedure Act and relevant case law, the court held that costs should follow the event and awarded costs to the 1st Respondent and 1st Interested Party, subject to assessment by the Taxing Master. The other respondents did not oppose withdrawal without costs and were not awarded costs.
