The subsequent delay was due to the court's failure to supply the proceedings in time, for which the applicants could not be faulted. Although the applicants did not exhibit a draft memorandum of appeal or demonstrate the merits of the intended appeal, this omission alone did not disentitle them from the orders sought, as the application was otherwise meritorious. The court exercised its discretion to avoid injustice and granted the extension of time, directing that the memorandum and record of appeal be filed and served within fourteen days.
