Criminal Appeal / Ruling on Application for Bail Pending Appeal

  1. 1 Whether the applicant has demonstrated exceptional or unusual circumstances to warrant grant of bail pending appeal.
  2. 2 Whether the applicant is entitled to bail pending appeal after conviction for defilement.

Ratio Decidendi

The court held that the applicant had not demonstrated any exceptional or unusual circumstances to justify the grant of bail pending appeal. The fact that the applicant was on bond during trial does not, by itself, entitle him to bail after conviction. The court emphasized that the right to bail under Article 49(1)(h) of the Constitution applies to accused persons pending trial, not to convicts. The applicant failed to show, through affidavit or otherwise, that there existed a set of circumstances disclosing substantial merit in the appeal or that the appeal was likely to succeed. The court exercised its discretion judiciously and found no basis to grant the orders sought.
