The court found that the Environment and Land Court has jurisdiction to determine disputes arising from charges over land, even where the underlying transaction is a commercial contract, as provided by the Land Act, 2012. The applicant sought an order for maintenance of status quo rather than an injunction. However, the court determined that the suit property had already been sold at public auction prior to the hearing of the application, fundamentally altering the state of affairs. As such, granting an order for status quo would serve no useful purpose and would unfairly affect the purchaser, who was not a party to the proceedings.
