Ratio Decidendi

The court found that plot KISA/SHIBINGA/517 was validly sold to Clide Muka, as evidenced by tribunal proceedings and a vesting order from the Chief Magistrate's Court, and thus does not form part of the estate for distribution. Regarding plot KISA/SHIBINGA/480, although the objectors are closer relatives to the deceased, the petitioner and his family have been in occupation, and his father cared for the deceased. The court held that it would be unfair to evict the petitioner, and therefore ordered that the petitioner receive 1.5 acres of plot 480, with the remainder to the objectors. The court declined to revoke the grant but adjusted the distribution to reflect these findings.
