Ratio Decidendi

The court held that Section 88 of the Kenya Railways Corporation Act expressly prohibits execution of judgments against the Respondent by way of attachment and sale of its property. Therefore, the warrants of attachment issued against the Respondent were illegal ab initio. The court found that it was unnecessary to consider other principles relating to stay of execution, as the law does not permit the process initiated by the Claimant. The Respondent's application was prompted by an illegal process, and the Claimant's arguments regarding delay and security were irrelevant in light of the statutory bar. Consequently, the warrants of attachment were recalled and set aside.
