Procedural Posture

Civil Suit / Interlocutory Application for Injunction

  1. 1 Whether the applicant is entitled to an interlocutory injunction restraining the respondent from dealing with the suit land pending determination of the suit.
  2. 2 Whether the conditions for grant of an injunction have been met under Order XXXIX of the Civil Procedure Rules.
  3. 3 Whether an inhibition order should issue to preserve the suit property.

Ratio Decidendi

The court found that the applicant, who claims adverse possession and is in possession of the suit land, established sufficient grounds for the preservation of the property pending the hearing and determination of the suit. The respondent did not oppose the application. The court held that it is in the interest of justice to grant an interlocutory injunction restraining the respondent from dealing with the suit land and, suo moto, issued an inhibition order to prevent any registration of dealings with the land until the suit is determined or further orders are made. The orders were made to ensure the subject matter of the litigation is preserved and the ends of justice are met.

Court Disposition

Application allowed. Injunction and inhibition order granted.

Orders
