Ratio Decidendi

The court found that although the Persons with Disabilities Act was in force at the time of the Claimant’s retirement, the Claimant was not registered as a person with disability by the National Council for Persons with Disabilities until 2013, well after his retirement in 2005. The court held that legal entitlement to the benefits and protections under the Act, including retirement at age 60, is contingent upon such registration. Since the Claimant was not certified as a person with disability at the material time, the Respondent could not be faulted for retiring him at age 55 in accordance with staff rules. The claim for unlawful and discriminatory retirement therefore failed.
