Ratio Decidendi

The court held that it lacks jurisdiction to review or revise a sentence imposed by another judge of concurrent jurisdiction. The revisionary powers of the High Court under Article 165 of the Constitution and Section 364 of the Criminal Procedure Code are confined to decisions of subordinate courts. The law prohibits a judge from sitting in review or appeal over decisions of their peers of equal and competent jurisdiction. Furthermore, where an appeal is available and not pursued, revision cannot be entertained at the instance of the party who could have appealed. Consequently, the application for review of sentence was dismissed for want of jurisdiction.
