The Tribunal found that the only valuation evidence before it was the landlord's report, as the tenant failed to file any counter-valuation. The landlord's valuation was based on comparable properties in the Nairobi CBD, which were found to be reasonable and similar in construction and location to the subject premises. The Tribunal accepted the landlord's assessment of market rent, determining that the proposed increment reflected the rent the premises might reasonably be expected to fetch in the open market.
