Ratio Decidendi

The court found that while causes of action generally survive the death of a party under the Law Reforms Act, spousal rights in matrimonial property are personal and do not devolve to the estate or legal representatives. The Matrimonial Property Act vests such rights in spouses according to their contribution, and upon death, the property devolves to the surviving spouse, who is already a party to the suit. The applicants, as sons and legal representatives, cannot claim or be substituted for spousal rights that are not inheritable. The application for substitution and reinstatement of the abated suit was therefore dismissed.
