Ratio Decidendi

The High Court found that the Lower Court erred in its assessment of the evidence by disregarding the clear indication from the police sketch plan that the point of impact was in the Appellant's lane, which contradicted the Respondents' version that their vehicle was parked. The court held that the absence of the Appellant's personal testimony was not fatal to the case since the driver, who had direct knowledge, testified. The Lower Court's finding that the Appellant had not proved her case on a balance of probabilities was therefore incorrect. The appellate court reversed the Lower Court's decision and entered judgment for the Appellant as claimed in the Plaint.
