Ratio Decidendi

Although the Chief Magistrate's Court at Bungoma has jurisdiction to hear and determine the suit, sound administrative reasons support transferring the case to Kisumu, where the cause of action arose, the defendant resides, and the witnesses are based. Allowing plaintiffs to freely choose forums distant from the locus of the dispute risks forum shopping and potential abuse. The interests of justice and convenience are best served by transferring the suit to Kisumu. The decision does not overturn the prior finding on jurisdiction but exercises the court's discretion to transfer the matter for proper and efficient administration of justice.

Orders
