The Tribunal found that the preliminary objection raised by the landlord did not meet the legal threshold for a preliminary objection as established in Mukisa Biscuit Manufacturing Co. Ltd. v. West End Distributors Ltd. The objection required the Tribunal to inquire into contested evidential matters, which is contrary to the principle that a preliminary objection must be based solely on pure points of law. Since the facts relied upon by the landlord were disputed and required proof, the preliminary objection could not be sustained.
