The court found that the particulars of the offence in the charge sheet and the facts narrated by the prosecutor did not disclose any offence, as they failed to indicate when the conspiracy or attempted defilement took place, the role of the alleged co-conspirator, or the specific acts constituting the offence. This failure was material and rendered the plea of guilty equivocal. As a result, the conviction based on such a plea could not stand, and the charge was fatally defective. The court therefore quashed the conviction and set aside the sentence, ordering the appellant's release unless otherwise lawfully held.
