Miscellaneous Application / Ruling on Application to Strike Out Plaint

  1. 1 Whether the plaint should be struck out for lack of proper authority and verifying affidavits in a representative suit.
  2. 2 Whether the plaintiff was required to obtain leave of court or provide notice to co-owners before instituting the suit.
  3. 3 Whether the absence of verifying affidavits from other plaintiffs invalidates the suit.
