Ratio Decidendi

The Court found that the Land Registrar acted ultra vires by authorizing the amendment of the Registry Index Map (R.I.M.) to effect an exchange of parcels between the appellant and the respondent without the consent of the registered proprietor or her legal representative. The Registered Land Act does not permit such amendments except for boundary corrections and only with the consent of all interested parties. The relatives of the deceased proprietor, not being appointed legal representatives, lacked capacity to consent to or transact in the suit land. Consequently, the respondent's occupation of the appellant's land was unlawful, and the purported exchange and amendment of the R.I.M....
