Ratio Decidendi

The court found that while there was a valid reason for the termination of the Claimant's employment—namely, her failure to account for advances—this did not justify summary dismissal, particularly as the Respondent had already recovered the outstanding amounts from her salary. Furthermore, the Respondent failed to follow due process as required by Section 41 of the Employment Act, as there was no evidence that the Claimant was invited to or participated in a proper disciplinary hearing. The court held that the dismissal was procedurally unfair and unjustified, and thus the Claimant was entitled to compensation for unfair dismissal, NSSF contributions, and costs.

Court Disposition

Claim allowed in part; Claimant awarded compensation for unfair dismissal, NSSF contributions, and costs.

Orders

  • Respondent to pay Claimant 12 months salary as compensation for unfair dismissal (Kshs 966,000).
  • Claimant to claim pension contributions directly from the fund.
