Ratio Decidendi

The court found that the Defendant failed to provide any written contract or documentary evidence to support his claim of co-purchasing the suit land, as required by Section 3(3) of the Law of Contract Act. The Defendant did not file a counterclaim or produce proof of purchase. The Plaintiff, as the registered owner, was entitled to deal with the land as per her late mother's wishes. The restriction placed by the Defendant was therefore unjustified. In the absence of a valid legal claim, the continued stay of the restriction was found to be improper, and the court ordered its removal under Section 76 of the Land Registration Act. Costs were awarded to the Plaintiff.
