Ratio Decidendi

The court found that the letters of grant of administration intestate had been issued to two administrators, but the suit was filed in the name of only one. Since the deceased's dependants are minors, section 58 of the Law of Succession Act requires that there be at least two administrators to file suit or claim for the estate. The omission to enjoin the second administrator was inadvertent. To comply with the law and ensure the interests of the minor dependants are protected, the court granted the application to enjoin the second administrator as a co-plaintiff. The court further ordered that costs be in the cause.
