The court found that the doctrine of res judicata was not established because the previous suit, Miscellaneous Civil Suit No. 709 of 2012, did not conclusively determine the issue of ownership of LR No. 36/VII/254. The consent order in the earlier suit only addressed the removal of a caveat and did not resolve the substantive question of ownership, which remains central to the present proceedings. Furthermore, the parties in the two suits are not identical, as neither the 1st Defendant nor the Plaintiff in the current suit were parties to the previous litigation.
