Ratio Decidendi

The court found that the plaintiffs satisfied the requirement of Order 37 Rule 7(2) by annexing a certificate of official search, which is sufficient evidence of title. However, the defendant was not the registered owner of the suit land at the time the suit was filed, having transferred the land to a third party prior to the institution of the suit. As such, the defendant lacked the capacity to be sued for adverse possession, and was wrongly joined in the suit. The originating summons and the suit were therefore struck out.
