Procedural Posture

Miscellaneous Application / Ruling on Application for Extension of Time

  1. 1 Whether the court should extend time for the applicant to secure the attendance of a witness and file additional documents.

Ratio Decidendi

The court found that the applicant had provided a satisfactory explanation for the delay in complying with the previous orders, namely the unavailability of a key witness who was outside the country and difficulties in obtaining investigation reports. Guided by the principles that courts have discretion to extend time where justice demands and that a satisfactory explanation for delay is required, the court exercised its discretion in favour of the applicant. The application for extension of time was therefore allowed, with no order as to costs.
