The court found that the respondent, as a diplomatic agent, is entitled to immunity from the jurisdiction of Kenyan courts under Article 31 of the Vienna Convention on Diplomatic Relations and the Privileges and Immunities Act. The employment of a domestic worker by a diplomat is not considered a commercial activity outside official functions and thus does not fall within the exceptions to immunity. The respondent's diplomatic passport was sufficient proof of her status as a diplomat, and the absence of a ministerial certificate did not negate her immunity. Consequently, the court lacks jurisdiction to entertain the suit, and the claim must be struck out.
