The High Court found that the Tribunal, having expunged the affidavits which contained the essential documents required for the determination of the appeal, lacked a proper basis to adjudicate the matter. The absence of the mandatory documents meant the Tribunal could not assess the procedure followed by the Commissioner in issuing the surcharge orders. Furthermore, the Tribunal erred in granting summary judgment against the appellants when the respondent had not sought such relief in its pleadings or submissions.
