The evidence showed that the Claimant was summarily terminated after raising health concerns related to her work environment, and there was no credible evidence that she resigned or that her request for early retirement was accepted. The court held that the termination was both substantively and procedurally unfair. However, claims for gratuity and leave pay for the period 1998 to 2005 were statute barred at the time of filing.
