Ratio Decidendi

The court found that the Respondent failed to prove that the Claimant was properly notified of a two-month extension or that she accepted such terms. The Respondent's departure from its established practice of issuing written, signed contracts and the lack of evidence that the Claimant received or signed the alleged extension letter led the court to conclude that the contract was renewed by conduct for a further term. The premature termination of this renewed contract, without just cause or due process, rendered the dismissal unlawful and unfair. The Claimant was therefore entitled to compensation for unfair termination, salary in lieu of notice, and salary for days worked in June 2014....
