The High Court found that the defence of res judicata under section 7 of the Civil Procedure Act did not apply because the main issue—continued occupation of the suit property—had not been finally determined in the Chief Magistrate’s Court, and the parties and issues in the two suits were not identical. Section 6 was also inapplicable for the same reason. However, the court held that the Plaintiff’s application was an abuse of process because the 2nd Defendant was only joined after the amendment, and as per Atieno v Omoro, the proceedings against him are deemed to have commenced at the date of amendment, not the original suit filing.
