Ratio Decidendi

The Tribunal found that while the Applicants' arguments for joinder had merit and the intended interested parties should ordinarily be given an opportunity to be heard, there were no active proceedings before the Tribunal to which they could be properly joined. The Tribunal had previously dismissed the Tenant's application to set aside the Landlord's orders, and the reference that could have formed the basis for joinder had lapsed without being reinstated. As such, any joinder at this stage would be futile. The Tribunal advised that the Applicants could better ventilate their issues by filing a fresh reference or moving to the Environment and Land Court, which has jurisdiction over...
