The Court found that although the Plaint was improperly intituled with references to constitutional provisions and appeared similar to a constitutional petition, the substance of the pleading clearly set out a claim for defamation in accordance with the Civil Procedure Rules. The inclusion of constitutional references in the heading was a drafting irregularity that did not mislead the Defendants as to the true nature of the claim, which was for defamation and not for enforcement of constitutional rights.
