The court found that the Applicants had provided a reasonable explanation for the delay in filing the appeal, namely the late availability of certified proceedings and the intervening death of the original Applicant. The period between the readiness of the proceedings and the filing of the application was not inordinate. The Respondent failed to demonstrate any prejudice that would result from granting the application. The court exercised its discretion to allow the substitution of parties, grant leave to appeal out of time, and stay the proceedings in the lower court pending the determination of the intended appeal. The application was therefore merited and allowed.
