The 2nd defendant was not a legal entity capable of being sued. Even if liability had been established, the plaintiff failed to prove the deceased's income or special damages, and the only possible award under the Fatal Accidents Act would have been Ksh.250,000 for loss of dependency, subject to apportionment. The suit was dismissed with costs to the defendants.
