The court found that the Claimant was suspended in 2001, prior to the coming into force of the Employment Act 2007. Under the then applicable law (Employment Act, Cap 226), employers were not required to observe principles of natural justice in termination or suspension, and could act at will. The Claimant failed to submit the terms and conditions of his employment, and the letter relied upon did not amount to reinstatement but rather redeployment to a different position. There was no evidence connecting the prior employment to the redeployment.
