Ratio Decidendi

The court found that the applicant's request to have the period spent in custody considered in his sentence had already been determined in a previous petition (Embu High Court Petition No. 12 of 2020), where it was held that the trial court had indeed considered the period in question. As such, the matter was res judicata and the High Court lacked jurisdiction to entertain the application. Furthermore, even if the issue had not been conclusively determined, the High Court would still lack jurisdiction to review a decision of a court of concurrent jurisdiction; the proper forum for such a challenge would be the Court of Appeal. The application was therefore dismissed for want of jurisdiction.
