The court found that the Respondent terminated the Claimant's employment on grounds of redundancy but failed to comply with the mandatory procedural and substantive requirements under Section 40 of the Employment Act. No notice was given to the Claimant, the Labour Office, or any trade union, and no evidence of fair selection or payment of terminal dues was provided. The Respondent also failed to prove that the Claimant's salary was consolidated to include house allowance. As a result, the termination was both substantively and procedurally unfair. The Claimant was awarded three months’ salary as compensation, one month’s salary in lieu of notice, and house allowance for five months....
