Under section 90 of the Employment Act, 2007, the claim should have been filed within three years of termination or within twelve months of cessation of a continuous injury. The suit was filed on 29th June 2015, which was beyond both limitation periods. The court held that the suit was time-barred and therefore dismissed the claim. The issue of limitation, though raised late by the respondent, was dispositive and warranted dismissal of the suit. Each party was ordered to bear its own costs.
