Ratio Decidendi

The court found that the claimant was terminated on the basis of mere suspicion without any evidence of wrongdoing, as admitted by the respondent's own witness. The respondent failed to provide the claimant with a fair hearing or an opportunity to respond to the allegations, in violation of Section 41 of the Employment Act, 2007. The termination was therefore both substantively and procedurally unfair under Section 45 of the Act. The court further noted the aggravating circumstances, including the false accusation and delayed payment of terminal benefits, and determined that the claimant was entitled to maximum compensation equivalent to twelve months’ salary.
