Ratio Decidendi

The High Court held that as at the time the application for reinstatement was filed and determined (2016–2018), Order 17 Rule 2 of the Civil Procedure Rules had not yet been amended to permit such applications. The court found that, in the absence of the 2020 amendment, the trial court was functus officio upon dismissal of the suit for want of prosecution and lacked jurisdiction to entertain the application for reinstatement. The only remedy available to the aggrieved party was to appeal the dismissal order. Consequently, the appeal against the trial court's refusal to reinstate the suit was dismissed, as the lower court had no jurisdiction to grant the relief sought.
