Ratio Decidendi

The court found that the applicant had not met the high and stringent threshold required for a stay of proceedings. The trial court had properly considered the relevant provisions of the Civil Procedure Act regarding jurisdiction and the place of suing. The subject matter, a movable chattel (motor vehicle), was ordinarily operated in Meru, and the prayers sought in the suit related both to protection of the chattel and settlement of the sale consideration, which could ascribe to different territorial jurisdictions. Granting a stay would prejudice the respondent and was not justified by the circumstances. The application was therefore dismissed.
