The intended appeal was found to be arguable, particularly on whether the remedies granted complied with Section 49 of the Employment Act. On the nugatory aspect, the Court accepted the applicant's contention that the respondents' financial position was unknown and that they may not be able to refund the decretal sum if the appeal succeeded, which would render the appeal nugatory.
