The Court of Appeal found that the learned single Judge failed to consider relevant and uncontested evidence that the delay in filing the original appeal was partly caused by missing court files and documents in the High Court Registry. This omission constituted a failure to take into account a material factor in the exercise of judicial discretion. The Court held that such failure justified interference with the single Judge's decision. Consequently, the Court set aside the ruling and granted the applicant an extension of time to file the Notice of Appeal within seven days and the record of appeal within fourteen days thereafter.
