Ratio Decidendi

The Court found that since three appeals arose from the same judgment, it was in the interest of justice and judicial consistency to adjourn the present appeal so that all related appeals could be heard together by the same bench. The Court noted the improper conduct of the respondent's counsel in failing to attend court at the scheduled time, but determined that the risk of conflicting decisions outweighed the inconvenience caused. The Court ordered that the submissions made so far be expunged and the hearing commence de novo, with the respondent to pay the appellant's thrown away costs assessed at KES 20,000 before the appeal is next set down for hearing.
