Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court erred in not awarding damages for the first and second ratoon crops.
  2. 2 Whether the appellant was entitled to damages for the ratoon crops under the contract and pleadings.

Ratio Decidendi

The court found that the appellant had sufficiently pleaded for damages for the ratoon crops in the plaint and that the contract entitled him to compensation for both the plant crop and two ratoon crops. The trial court erred in failing to award damages for the ratoon crops. The appellate court substituted the trial court's award with a total compensation of Kshs. 2,312,640, subject to transport and harvesting charges to be agreed upon by the parties and deducted before the Deputy Registrar. The net sum would attract interest at court rates from the date of filing of the plaint, and the appellant was awarded costs of the appeal.

Court Disposition

appeal allowed; trial court judgment set aside and substituted with award for appellant subject to deductions.

Orders
