Ratio Decidendi

The court found that the engineer's report relied upon by the defendants did not constitute new and important evidence as contemplated by Order 45 Rule 1(b) of the Civil Procedure Rules. The defendants, being the parties carrying out the construction, were or ought to have been aware of the status of the works and should have raised any issues regarding necessary outstanding works during the earlier hearings. The report was procured after the fact and appeared to be an attempt to obtain a favourable order to continue construction, contrary to the court's previous ruling. The application for review was therefore without merit and dismissed with costs to the plaintiff.
