The High Court had previously dismissed the application to set aside the award on the ground that it was premature, without addressing the merits of the award itself. Therefore, the doctrine of res judicata did not apply. The court reasoned that proceeding with the application for recognition and enforcement of the award before the appeal is determined could render the appeal superfluous and potentially prejudice the applicant.
